Registration, Licensing & Infringement Representation for Creators & Businesses
Creative work has real economic value, and protecting it takes more than a copyright symbol on a webpage. At Atkinson, Baker & Rodriguez, P.C., we help Albuquerque creators and businesses navigate copyright registration, licensing agreements, and infringement disputes through the same bold, strategic approach we’ve built over more than 30 years of practice. Our reach extends regionally and nationally, and our track record reflects our focused, aggressive advocacy.
Copyright concerns move quickly, especially when infringement is ongoing. Call (505) 764-8111 to speak with our team about your situation.
A Firm Built for Complex, Document-Heavy Cases
Copyright disputes often turn on records: licensing chains, registration certificates, work-for-hire agreements, metadata, and digital file histories. We integrate cutting-edge technological resources to manage exactly this kind of evidence-intensive work, so our attorneys arrive at every negotiation and courtroom argument with the record organized and ready.
Our attorneys have been recognized by Best Lawyers in America©, Southwest Super Lawyers©, and Chambers & Partners©. We’ve recovered millions in compensation for clients through negotiation, settlement, and litigation. Because we maintain multiple practice areas under one roof, clients who come to us for copyright matters can call on the same attorneys for related business, commercial, or litigation needs.
Copyright Registration: Why Timing Matters
Copyright protection attaches automatically when an original work is fixed in a tangible medium, whether that’s a manuscript, a software application, a painting, or a recorded song. Registration with the U.S. Copyright Office isn’t required to own a copyright, but it is required before an infringement lawsuit can be filed in federal court. That distinction becomes significant the moment someone else uses your work without permission.
Registering before publication, or shortly after publication, opens up additional remedies if infringement occurs later, including statutory damages and attorney’s fees. Waiting until a dispute arises limits your options. We walk clients through the registration process and advise on timing so the legal foundation is in place before it’s needed.
Copyright Infringement: Rights, Violations, & Resolution
A copyright owner holds a bundle of exclusive rights: to reproduce the work, create adaptations, distribute copies, and publicly display or perform it. Those rights can also be transferred, in whole or in part, to another party. When someone exercises any of these rights without authorization and without a valid defense, that’s infringement.
Infringement disputes don’t always go to trial. Many resolve through cease-and-desist demands, negotiated settlements, or structured licensing arrangements. When they don’t, federal court is the venue. We pursue the path that serves our clients’ interests and don’t treat litigation as the default when a faster resolution is available.
Licensing & Fair Use: Structuring Rights Before Disputes Arise
Not every copyright question involves a violation. Often, the work is to structure rights clearly from the start. A creator can license specific rights, such as the right to adapt a work for film or reproduce it in a publication, while retaining the underlying copyright. A well-drafted licensing agreement defines what’s permitted, for how long, in what territory, and on what terms.
Fair use allows limited use of a copyrighted work without permission in certain contexts, including commentary, criticism, or parody, but the line between fair use and infringement isn’t always obvious. We help clients evaluate fair use questions and draft or review licensing agreements before they become the subject of a dispute.
Federal Jurisdiction Over Copyright Claims
Copyright law is federal law, grounded in the U.S. Constitution’s grant of power to Congress to secure exclusive rights for authors. Copyright infringement claims filed in New Mexico are heard in the U.S. District Court for the District of New Mexico, not state court, with appeals going to the U.S. Court of Appeals for the Tenth Circuit. Knowing the forum matters for case strategy, and our attorneys are practiced in federal civil litigation.
